1. Acceptance and availability

These General Terms and Conditions of Purchase govern the legal relationship arising from the contracting processes carried out between user-customers and My Home Bench, S.L.U., owner of this e-commerce store. By accepting these Terms, the User declares that they are of legal age and have the legal capacity to contract, and that they have read and accepted these Terms.

The User accepts the Terms from the moment they use, contract or purchase any product. In the event of any amendment, My Home Bench, S.L.U. will always honour those the User accepted at the time of purchase. For any queries: info@pizarrasbaloncesto.com.

2. Applicable legislation

Royal Legislative Decree 1/2007 (consolidated text of the General Law for the Defence of Consumers and Users, TRLGDCU).

Law 7/1998 of 13 April on General Contracting Conditions.

Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE).

Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

For sales to consumers in other EU Member States, the consumer protection rules mandatorily applicable in their country of residence.

3. Territorial scope

The online store provides service to users in Spain (mainland, Balearic Islands, Canary Islands, Ceuta and Melilla) and in the Member States of the European Union. Certain destinations outside mainland Spain may be subject to a specific tax and customs regime (for example, the Canary Islands, Ceuta and Melilla as export territories), which will be reflected in the order documentation.

4. Purchase process

To purchase a product, the User must select it, configure it where applicable using the personalisation tools, add it to the cart and confirm the order following the on-screen instructions, having first accepted the Privacy Policy and these Terms. Confirmation of the order and payment constitutes the conclusion of the contract.

5. Prices

Product prices include Value Added Tax (VAT) or other applicable indirect taxes. The applicable final price is the one in force at the time of order confirmation. Prices and features may be modified at any time, without this affecting orders already confirmed.

6. Shipping costs and times

Spain (mainland and Balearics):

FREE shipping for orders equal to or above €60.00 (VAT included).

For orders below €60.00, a shipping cost applies that depends on the service selected (standard or Premium) and not on the destination. The exact amount is shown in detail before the order is confirmed.

European Union:

The product prices shown are the same as for Spain, and the same shipping conditions apply: free for orders of €60.00 or more and, below that amount, the cost of the service selected. The Premium service is not available for all destinations; during checkout, only the options available for the address provided are offered.

Canary Islands, Ceuta and Melilla:

These destinations may be subject to customs procedures and local taxes (IGIC, IPSI or others) whose handling and, where applicable, payment may fall to the recipient in accordance with the regulations in force.

Priority production (optional):

Voluntary service for an additional charge (€9 on standard orders; €49 on club orders of 10 or more units). Always optional, never applied by default.

7. Payment methods

Spain: bank card (Redsys and Stripe, including Apple Pay and Google Pay), PayPal and bank transfer.

Rest of the EU: bank card and local payment methods (Stripe) and PayPal.

Card payments are processed through secure gateways (Redsys / Stripe) over an encrypted connection; My Home Bench, S.L.U. does not store full card details. For bank transfers, account details are provided after order confirmation; if payment is not recorded within 10 calendar days, the order may be cancelled automatically.

8. Right of withdrawal

The right of withdrawal regime is detailed in the "Cancellations and Returns" document, an integral part of these Terms. It is expressly noted that, in accordance with Article 103.c of the TRLGDCU, there is NO right of withdrawal for personalised products or those made to the consumer's specifications.

9. Intellectual property

The content supplied by My Home Bench, S.L.U. is subject to intellectual and industrial property rights. The purchase of a product confers no right of alteration, exploitation, reproduction, distribution or public communication over it. The customer may not make such content available to third parties without the prior written consent of the owner.

10. User responsibility

The User undertakes to make lawful and good-faith use of the service, and is responsible for the truthfulness, accuracy and updating of the data provided, in particular the email address indicated as the main means of contact.

11. Partial invalidity

If any clause is declared null or ineffective, such nullity will affect only that provision, with the Terms remaining in force in all other respects.

12. Applicable law and dispute resolution

These Terms are governed by applicable Spanish and EU law. Where the User acts as a consumer, the mandatory protection rules of their country of residence in the EU will apply. The European online dispute resolution platform is available at: https://ec.europa.eu/consumers/odr.
